The service
Vigil HSE provides subscription software for managing workplace health, safety and environment programs. Your subscription tier determines the worker-count band; all functional modules are included at every tier.
Your responsibilities
- Keep your account credentials secure and access limited to authorized personnel.
- Ensure you have the right to enter your workers' information into the system, and use role restrictions appropriately for sensitive data.
- Use the service lawfully and in accordance with your regulatory obligations.
The essential disclaimer
Vigil supports compliance; it does not constitute legal, engineering or professional safety advice, and it never replaces competent judgment. Regulatory citations are provided from official published sources and verified against them, but legislation changes and your circumstances are your own. Certification decisions (including COR) belong to certifying bodies, not to software. For hazards requiring specialized professional competence, engage a qualified professional.
Data
Your data is yours. You can export it during your subscription and on the way out. We process it to provide the service, as described in the Privacy Policy, and protect it as described on the Security page.
Billing
Monthly plans bill monthly and may be cancelled anytime, effective at the end of the billing period. Annual plans bill yearly at the equivalent of ten monthly payments. Fees are in Canadian dollars, exclusive of applicable taxes.
Availability & liability
We operate the service with production monitoring and take uptime seriously, but the service is provided "as is" without warranty of uninterrupted availability. To the maximum extent permitted by law, Vigil's aggregate liability is limited to the fees paid in the twelve months preceding the claim. Nothing in these terms limits liability that cannot lawfully be limited.
Changes
We may update these terms; material changes will be notified to account owners in advance. Continued use after the effective date constitutes acceptance.
Governing law
These terms are governed by the laws of Alberta and the federal laws of Canada applicable therein.
